By accessing or using melech.ca (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site.

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. The "Last updated" date at the bottom of this page reflects the most recent revision.

The Site is provided for informational purposes about Melech Retail's consulting services and to allow prospective clients to submit inquiries.

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use of the Site. Prohibited conduct includes, but is not limited to:

• Transmitting any content that is unlawful, harmful, defamatory, or otherwise objectionable • Attempting to gain unauthorized access to any part of the Site or its infrastructure • Using automated tools (scrapers, bots, crawlers) to extract content without our prior written consent • Transmitting spam or unsolicited commercial communications through the contact form

All content on the Site — including text, graphics, logos, images, and the overall design — is the property of Melech Retail or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may view, download, and print content from the Site solely for your own personal, non-commercial reference. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written permission.

The Melech Retail name, logo, and associated marks are trademarks of Melech Retail. Nothing on the Site grants any licence to use our trademarks.

When you submit an inquiry through our contact form, you are initiating a communication with Melech Retail for the purpose of exploring a potential consulting engagement.

Data handling. Information you submit (name, email, company, and message) is transmitted via our email delivery provider (Resend) directly to our inbox. This data is used solely to evaluate and respond to your inquiry. It is not shared with third parties for marketing purposes. Full details are set out in our Privacy Policy.

No solicitation. By submitting the contact form, you confirm that your communication is a genuine business inquiry. Use of the contact form to send unsolicited commercial messages, spam, or irrelevant communications is prohibited.

No automatic relationship. Submitting an inquiry does not create a client relationship, engagement agreement, or any legal obligation between you and Melech Retail. An engagement only begins upon execution of a written consulting agreement.

Response times. We endeavour to respond to all inquiries within two business days. We do not guarantee a response to all submissions and reserve the right to decline any inquiry.

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

General information only. The content on this Site describes Melech Retail's services and capabilities at a general level. It does not constitute professional advice. You should not rely on any content on this Site as a substitute for qualified professional advice tailored to your specific circumstances.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, Melech Retail and its principal(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of these Terms or your use of the Site shall not exceed CAD $100.

The Site may contain links to external websites, including LinkedIn and our founder's employer's website. These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or policies of any third-party site. Your use of linked sites is at your own risk.

These Terms and your use of the Site are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada. You irrevocably attorn to the jurisdiction of those courts.

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Melech Retail with respect to your use of the Site and supersede all prior understandings, representations, or agreements relating to the same subject matter.
